WOAH is building the largest dance studio in the world. It’s a one-on-one virtual dance learning app for kids who wish to learn dancing anytime, anywhere.

We take your privacy very seriously, so we ask you to read the following privacy policy carefully.

Woah Edutainment (Israel) Ltd., of 8 Hasdnaot St. Herzlia, 4672835, Israel (“WE”) is the Controller of your personal information, which means that we are responsible for how and why your personal information is being processed.

In this Privacy Policy, the term “processing” means any activity performed on personal data, including, for example, collecting, storing, modifying, transferring or otherwise using it.

This Privacy Policy may contain references to several data protection laws which may not apply to your specific country or jurisdiction. In addition, certain jurisdictions may prohibit or limit the collection, use or sharing of specific categories of personal data; accordingly, this Privacy Policy describing our practices may be limited by those laws and/or further clarified in any country-specific sections applicable to you within this Privacy Policy.

This Privacy Policy sets out how and why we collect, store, process and share your personal data and applies to all the personal information we collect about you when you interact with us:

WHAT DATA ABOUT ME IS COLLECTED AND HOW IS IT USED?

Under Article 6(1) of the GDPR, we are only permitted to process your data if there is a legal basis to do so. A legal basis for processing your data will arise when one or more of the following conditions apply:

  • Consent: You have given us your consent to the use of your data which can be revoked at any time;
  • Contract: We may use your data because you have entered into an agreement with us to provide you with a service.
  • Legal obligation: We may be required to process your information in order to comply with certain legal obligations;
  • Legitimate interest: We might use your information because we have—or a third party has—a legitimate interest in doing so. This happens only in cases where we think the way we are using your data doesn’t significantly impact your privacy or would be expected by you, or there is a compelling reason to do so.

DATA COLLECTION, USES AND LEGAL BASIS

1.When you create a Woah App account, we collect:

- Account login information user nickname, login credentials (which are either email and password, or login via Apple / Facebook)

- Log information i.e., date and time of app download, account user log in etc.

- Age, Country and IP Address. Where the consent of a parent or guardian is required, we will collect the email or telephone of the parent or guardian.

Uses: To set up your Woah App user account and profile, respond to your questions, account security and to provide you with any requested information (including app upgrades).

The legal basis is the contract with us by entering into the Woah APP Agreement and according to Art. 6(1)(b) GDPR.

- To comply with user age restrictions according to local data privacy regulations.

The legal basis is that this processing is necessary for our compliance with a legal obligation according to Art 6(1)(c) GDPR.

Where parental consent is required for the use of this app, the legal basis is according to Art 6(1)(a) GDPR. Details of the consent (date, time and parents’ email or phone number) will also be processed in compliance with data privacy regulations.

Parental consent may be withdrawn at any time by contacting us at privacy@woah.ai

2. When you use our app, we collect:

- Audiovisual information, such as pictures or video.

Uses: To allow you to use the app, facilitate its proper running, improve functionalities and for app development and maintenance reasons.

The legal basis is the contract with us by entering into the Woah APP Agreement and according to Art. 6(1)(b) GDPR.

3. When you visit our website, we collect:

- Usage data including the name and address of the requested content, the date and time of the access, volume of the transferred data, the access status (file transferred, file not found), the description of the used web browser and operating system version used, the referral link, which indicates from which Webpages from which the user's system reaches our webpage and the IP address of the user’s device.

Uses: The data is used to remember your website preferences: It also makes it easier to use the site. The usage data will only be processed anonymously.

The complete IP address transmitted by your web browser is stored for seven days for security purposes, to detect limit and eliminate attacks on our web pages. After this period, we delete or anonymize the IP address.

The legal basis is our legitimate interest according to Art. 6(1)(f) GDPR.

4. When you sign up to receive our marketing communications (Email, push notification, SMS etc.), we collect:

- Name, email address, telephone and marketing preferences.

Uses: This data is used to inform you about offers, products, events and surveys via the app, e-mail, SMS.

The legal basis is your consent which you can withdraw at any time.

WITHDRAWAL OF CONSENT

To withdraw your consent / opt out of getting our marketing messages, you may:

- manage your preferences via your woah app profile page

- email us at support@woah.ai

You may also unsubscribe from receiving marketing e-mails via the opt-out link included in each marketing e-mail.

How long we keep your data?

We retain your personal information as long as it is necessary to fulfil the specific purposes, as explained under the section “Why we collect your personal information”. In specific cases, a longer retention of your personal information might be required according to legal obligations.

In all other cases, we delete your personal information once the purpose of processing your information has been fulfilled.

Children

The WOAH app is appropriate for users of all ages.

Where required by law, we will collect the consent of a parent before we process the personal information of children as defined by applicable national law regulations.

Where the processing is based on consent, you (the consenting parent or child in applicable jurisdictions) may withdraw said consent at any time with effect for the future.

Data Security

We take reasonable steps to implement appropriate technical and organizational measures to protect your personal information. These measures are in compliance with applicable data protection and data security laws and are in place to prevent any risks, such as accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to your personal information.

How we share and disclose personal data

We will not share, sell, transfer or otherwise disseminate your personal data to third parties, unless required by law according to Art. 6(1)(c) GDPR, unless required for the purpose of your contract according to Art. 6(1)(b) GDPR, unless the third-party acts as a data processor on our behalf according to Art. 28 GDPR or you have given us express consent to do so according to Art. 6(1)(a) GDPR.

• Woah Edutainment is part of the AGT Company Group. We share some of your personal data with our parent company, subsidiaries, affiliates, and other entities controlled by AGT.

• We also use third-party service providers to offer or facilitate services on our behalf. We only share your data to the extent necessary for such providers to perform their services as instructed. These service providers include IT services, hosting, marketing, finance, advertising, archiving and document storage.

• Public or governmental authorities as required by applicable laws and regulations.

Where required by law, the appropriate data processing agreements have been concluded with these third parties.

Woah is not responsible for the policies of the third-party providers.

Some of the companies we share your Personal Data with as described above may be located outside of the European Economic Area. In each case, we ensure that an adequate transfer mechanism such as Standard Contractual Clauses, EU Commission adequacy decision or other applicable derogation under Art 49 GDPR are in place.

If the data is processed outside the EU or EEA and the legal basis is your consent according to Art 49 GDPR, please note that there is a risk that the local authorities may access the data for security and monitoring purposes without you being informed or having the right to appeal.

Your right as an EU / EEA data subject

The GDPR grants you certain rights when your data is being processed:

Right of information (Art. 15 GDPR)

You have the right to obtain confirmation as to whether personal data concerning you are being processed; if this is the case, you have the right to be informed of this personal data and to receive the information specified in Art. 15 of the DPA.

Right of rectification (Art. 16 GDPR)

You have the right to request the correction of incorrect personal data concerning you and, if necessary, the completion of incomplete data without delay.

Right to cancellation (Art. 17 GDPR)

You have the right to demand that personal data concerning you be deleted immediately if one of the reasons listed in Art. 17 GDPR applies.

Right to limit processing (Art. 18 GDPR)

You have the right to request the restriction of the processing if one of the conditions listed in Art. 18 GDPR is fulfilled, e.g., if you have lodged an objection to the processing, for the duration of the examination by the controller.

Right to data transferability (Art. 20 GDPR)

In certain cases, which are listed in detail in Art. 20 GDPR, you have the right to receive the personal data concerning you in a structured, common and machine-readable format or to request the transfer of such data to a third party.

Right of withdrawal (Art. 7 GDPR)

If the processing of data is based on your consent, you are entitled to revoke your consent to the use of your personal data at any time in accordance with Art. 7 Para. 3 GDPR. Please note that the revocation is only effective for the future. Processing that took place before the revocation is not affected.

Right of objection (Art. 21 GDPR)

If data is collected on the basis of Art. 6 para. 1 sentence 1 letter f GDPR (data processing to safeguard legitimate interests) or on the basis of Art. 6 para. 1 sentence 1 letter e GDPR (data processing to safeguard public interests or in the exercise of official authority), you have the right to object to the processing at any time for reasons arising from your particular situation. We will then no longer process the personal data unless there are demonstrably compelling reasons for processing which are worthy of protection and which outweigh your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims.

Right of complaint to a supervisory authority (Art. 77 GDPR)

According to Art. 77 GDPR, you have the right to appeal to a supervisory authority if you believe that the processing of data concerning you violates data protection regulations. In particular, the right of appeal can be asserted with a supervisory authority in the member state of your habitual residence, your place of work or the place of the suspected infringement.

If you do not expressly consent to receiving electronic communications, we will only communicate with you during the time period and for the limited purposes permitted under CASL.

Our company is Woah Edutainment in Israel and we are responsible for how your information is being collected and what is is being used to do.

WHAT INFORMATION DO WE COLLECT?

After you download the Woah App, we will collect your user name, password and birthday.  Depending on your age and where you live, we may need to contact your parents and get their permission before you are allowed to use this App.  

In order to keep the App working properly, help us understand how the App is being used and to follow the laws about privacy in different countries, we may also collect other information from the device which the app is on.  This information may be your IP address, country location web browser type and version, device ID and general usage data.   We also collect some information about how the App is used (e.g how hard some dances are, how long it takes to complete a level) to help us make our App better and more fun to use.

We only keep your information for as long as we need it to allow you keep using the App or as long as we are required to according to the different laws about keeping and destroying data.

WHO DO WE SHARE THIS INFORMATION WITH?

We need other companies to help us keep the App and our company working. We will only share your data if the privacy laws in your country allow us to do so and we have followed all the legal requirements or if your parents (or you in certain countries) have agreed to let us share the data (this is known as the legal basis).
